The case of Portland Cement Zambia has been going on for more than ten years. During this time, Dr. Mahtani and his lawyers submitted numerous documents, evidences as well as testimonials to prove his legal claims over the factory. Some of these documents and evidences included signed shareholder’s agreement, financial statements and investment exhibits that clearly proved investment worth more than USD 12 million from Dr. Rajan Mahtani owned Finsbury Investments. Another strong evidence was the independent audit report conducted by an independent auditor. As per the audit report, the factory was established as joint venture agreement and Dr. Rajan Mahtani is the sole joint venture partner of the factory. All these evidences clearly prove that Dr. Mahtani is the real owner of the factory.
The judge handling this case made the final verdict against Dr. Mahtani’s claims and it was clear that the judgment was misdirected. It seemed that the judge clearly ignored almost all of the evidences submitted by Dr. Mahtani and provided a final judgment which might have been influenced by external forces.
Dr. Mahtani is not the type of person who goes against the decisions made by the law. But when this decision is flawed risking the livelihood of common citizens, Dr. Mahtani is ready to take any step within the legal purview of the Zambian law and regulations. As such, Dr. Rajan Mahtani has now appealed to the higher court of Zambia and in his appeal, he has shared the evidences which were conveniently ignored by the judge. Reply from the higher court of appeal is awaited as of now.
